Photo and Video Waiver

By submitting this form and participating in online and/or in person activities as part of the SUDC Foundation's 2022 Family Retreat, I hereby grant permission to the SUDC Foundation and its representatives to take photographs and video recordings of myself and any other family attendees I have registered in this form, including legally dependent minors, and to make recordings inclusive of our recorded voices and names at the SUDC Foundation’s 2022 Family Retreat.

I further grant to the producers, the SUDC Foundation, its servants, agents or employees, and their representatives the right to reproduce, use, exhibit, display, broadcast, distribute and create derivative works of these images and recordings in any media now known or later developed, which may include my name or the names of anyone else listed in this consent. I acknowledge that the SUDC Foundation owns all rights to the images and records. I hereby waive any right to inspect or approve the use of the images or recordings or of any written copy. I further waive all moral rights. I also waive any right to royalties or other compensation arising from or related to the use of the images, recordings, or materials. I hereby release, defend, indemnify and hold harmless the producers, the SUDC Foundation, it servants, agents or employees, from and against any claims, damages or liability arising from or related to the user of the images, recordings or materials, including but not limited to claims of defamation, invasion of privacy, or rights of publicity or copyright infringement, or any misuse, distortion, blurring, alteration, optical illusion or use in composite form that may occur or be produced in taking, processing, reduction or production of the finished product, its publication or distribution. I am 18 years of age or older and I am competent to contract in my own name. I have read this document before signing below, and I fully understand the contents, meaning and impact of this consent, waiver, indemnity and release. This consent, waiver, indemnity and release is binding on me and any minors I may have included in this release, my heirs, executors, administrators and assigns.

Disclaimer:

You agree to follow all SUDC Foundation guidelines and all applicable laws while attending events and activities at the Retreat. You understand, agree, and hereby consent that your failure or disregard to follow any guidelines or laws in effect during your attendance at the Retreat is hereby sufficient grounds to be excluded from attending the Retreat by the SUDC Foundation in its sole discretion, and you hereby consent in advance to immediately leave and exit the Retreat, without protest or refund, upon request by the SUDC Foundation due to your refusal to follow said protocols, as determined in the SUDC Foundation’s sole discretion.

All SUDC Foundation guidelines, applicable laws, and details of the retreat are subject to change based on local and national COVID-19 mitigation guidelines and the rules, codes, regulations, instructions, and guidance from governing agencies, local authorities, the event location, and the SUDC Foundation to ensure the health and safety of all Retreat guests.

When making your travel arrangements, we would encourage you to ensure that your bookings are refundable. It is our hope to proceed with the event; however, the COVID pandemic is ever-present and evolving. Our goal will always be to ensure the safety of all participants. If the retreat needs to be canceled as determined in our sole discretion, the SUDC Foundation will not be responsible for any fees or penalties incurred by you resulting from the cancellation of the event, including but not limited to fees or penalties relating to rescheduling flights or travel plans. In the event of our cancellation of the Retreat for any reason, our sole liability to you will be the refund of the Retreat fees paid by you prior to cancellation, minus a reasonable convenience fee.

Liability Clause provided at time of signature:

As a condition of your participation in this Retreat, you hereby agree to assume full responsibility for, and to indemnify, hold harmless and defend the SUDC Foundation and each of its trustees, officers, employees and agents as well as any affiliated corporations, partnerships, and joint ventures from and against, any and all claims, demands, damages, judgments and liabilities (including, but not limited to, liabilities for penalties and reasonable attorney's fees) of any nature whatsoever resulting from or arising out of exposure to COVID-19, COVID variants or any other infectious disease or illness (“Infectious Disease”) on the part of the SUDC Foundation, its directors, officers, employees, agents, vendors, or independent contractors, or any other person as part of the audience for the Retreat or resulting from your traveling to or from the Retreat.

YOU UNDERSTAND AND AGREE THAT THE SUDC FOUNDATION DOES NOT ASSUME ANY RESPONSIBILITY OR OBLIGATION TO PROVIDE FINANCIAL OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, OR DISABLITY ASSISTANCE IN THE EVENT OF YOUR OR YOUR FAMILY’S INJURY OR ILLNESS. IN THE EVENT THAT YOU OR YOUR FAMILY MEMBER IS INJURED, BECOMES ILL, OR SUFFERS COMPLICATIONS AS A RESULT OF YOUR PARTICIPATION IN THE RETREAT, YOU AGREE TO RELEASE AND HOLD HARMLESS THE SUDC FOUNDATION FROM SUCH LIABILITY.

BY COMPLETING THE REGISTRATION FOR THIS RETREAT, YOU HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS WAIVER.
